1. What these terms cover
In these documents "TuneGrid", "we", "us" and "our" mean Tune Grid Pty Ltd, an Australian company (company registration in progress; the registered details, ABN and registered address will be added to this document on registration and shown in your portal settings). The platform runs on remapsolutions.com and its subdomains.
These terms govern use of the TuneGrid platform by everyone with an account: workshop owners and staff, and workshop customers. Workshops are additionally bound by the Service agreement (which prevails for commercial matters between TuneGrid and the workshop), and customers by the portal terms of the workshop they buy from. The Privacy policy explains data handling.
2. Your account
Sign-in is passwordless: we send a 6 digit code to your verified email or mobile. Keep control of that inbox and phone; anyone with your codes can act as you, and you are responsible for actions taken with your credentials until you tell us or your workshop that something is wrong. One person has one account identity; a customer account belongs to the workshop portal it was created on. You must be able to enter a binding contract to hold an account (in Australia, generally 18 or older).
3. Acceptable use
You must: use the platform only for lawful vehicle tuning work; upload only files you have the right to use; and keep your information accurate. You must not: upload malware or deliberately corrupted files; attempt to access other tenants' data or probe the platform's security; scrape the platform or reverse engineer its software, bundle formats or matching data; misrepresent who you are; use the platform to send spam; or route work matched through the platform around the platform to avoid fees owed under a workshop's service agreement. We may remove content and suspend accounts that break these rules, with notice and a chance to respond except where the risk requires immediate action.
4. Vehicles, emissions and warranties
Vehicle modifications are regulated. Modifying engine software can affect the vehicle's emissions compliance, roadworthiness, registration, insurance cover and manufacturer warranty. Laws differ by country and state, and in many places it is unlawful to remove or reduce the effectiveness of emission control systems (for example DPF, EGR, AdBlue or catalyst functions) on a vehicle used on public roads, regardless of any label on the product. Products described as motorsport or off-road only must not be used on public roads. You are responsible for confirming that any modification you order is lawful for the vehicle and its intended use in its jurisdiction before you buy it, and, when you order for a customer, for clearly explaining this to them. If you are unsure, ask your workshop or your local authority first.
Workshops are responsible for the legality and quality of the modifications they sell. TuneGrid operates the marketplace and does not author, check or certify workshop files.
5. Buying and selling
The workshop named on the portal and on your invoice is the seller of record for everything sold on that portal. Payments are processed by Stripe; TuneGrid never holds customer funds and is not a party to the sale. Prices are shown in Australian dollars unless the portal states otherwise. Tune files are digital products delivered as downloads or installed by your workshop.
6. Store credit
Workshops may issue store credit, mainly as a refund method. Store credit: is spendable only at the workshop that issued it; cannot be withdrawn as cash or transferred; does not expire; carries no fees; is capped at 1,000 Australian dollars per customer per workshop; and is a liability of the issuing workshop, not of TuneGrid. Store credit is not money, a deposit or an investment product. If a workshop leaves the platform, your statutory refund rights against that workshop are unaffected.
7. Refunds
A delivered tune file is a digital product that cannot be returned: once the file is delivered and the job is completed, the work has been performed and there are no refunds for a working tune. Change of mind refunds are not offered. Instant tunes are ready-made calibrations supplied as-is, which is why they cost less; custom tunes are built by the workshop's tuners for your file and include adjustments within the workshop's support window. Before every purchase you confirm these terms with a tick, and that confirmation is recorded. If something does not work: tell the workshop through the project's support thread, and the workshop will diagnose and fix it; if it cannot be fixed within the workshop's published refund window, you get your money back per the workshop's refund policy. Refunds for a failure of a consumer guarantee go back to your original payment method unless you expressly choose store credit. Nothing here limits your rights under the Australian Consumer Law or equivalent laws where you live: those rights apply regardless of any workshop policy, and a workshop's policy can only add to them.
8. Content and intellectual property
You keep the rights in files you upload and grant the workshop and TuneGrid the licence needed to store, process, match and deliver them to provide the service. Files delivered to you are licensed for the specific vehicle and job you bought them for, not for copying, reselling or applying to other vehicles. The platform's software, design, databases and documentation belong to TuneGrid and its licensors.
9. The AI help assistant
The "Ask TuneGrid" assistant is an automated AI system and is labelled as one. It answers from the platform's documentation and your own account context, and it can make mistakes. It does not give legal, financial or mechanical engineering advice, and its answers are not binding offers or commitments. Binding information comes from your workshop, our official documents or our support staff. Assistant conversations are handled per the Privacy policy.
10. Availability
We work to keep the platform available and your data safe (including backups and the security measures in the Privacy policy) but do not promise uninterrupted or error free operation. Planned maintenance is announced in advance where practical. Workshops' remedies for service failures are in the Service agreement; customers' remedies for a purchase are against their workshop, backed by consumer law.
11. Liability
Australian Consumer Law: our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to cancel the affected service and obtain a refund for the unused portion, or to compensation for its reduced value, and to compensation for any other reasonably foreseeable loss or damage. For failures that are not major you are entitled to have the failure remedied in a reasonable time. Nothing in this document excludes, restricts or modifies those guarantees or any other right you have under law that cannot be excluded. Where the law allows us to limit our liability for a guarantee failure (section 64A of the Australian Consumer Law, for goods or services not of a kind ordinarily acquired for personal, domestic or household use), our liability is limited, at our option, to resupplying the affected service or paying the cost of resupply, where it is fair and reasonable to do so.
Subject to that paragraph, and to the maximum extent the law allows: TuneGrid is not liable for the acts, omissions, files or services of workshops, for damage to vehicles arising from modifications a workshop sold or performed, or for indirect or consequential loss; and TuneGrid's total liability to a customer for platform faults is capped at 100 Australian dollars or the amount you paid TuneGrid directly in the last 12 months, whichever is higher. Workshops' liability to their customers is a matter between them under the workshop's terms and consumer law.
12. Changes
We may update these terms. For material changes we give at least 30 days notice in the portal or by email, and for workshops the Service agreement's change rules apply. The version you accepted is recorded; every version is archived. Continued use after the notice period is acceptance; if you do not agree, stop using the platform and, if you are a customer, contact your workshop about anything outstanding.
13. Law and disputes
These terms are governed by the laws of Queensland, Australia, and disputes go to the courts of Queensland (non-exclusive). Talk to support first: most problems are fixed there. Nothing in this clause stops you bringing a claim in your local courts or to your local consumer authority where the law gives you that right.
